About the Book: Although the adoption of market reforms has been a key factor leading to China's recent economic growth, China continues to be governed by a communist party and has a socialist-influenced legal system. Vietnam, starting later, also with a socialist-influenced legal system, has followed a similar reform path, and other countries too are now looking towards China and Vietnam as models for development. 

This book provides a comprehensive, comparative assessment of legal developments in China and Vietnam, examining similarities and differences, and raising important questions such as: Is there a distinctive Chinese model, and/or a more general East Asian Model? If so, can it be flexibly applied to social and economic conditions in different countries? If it cannot be applied to a culturally and politically similar country like Vietnam, is the model transportable elsewhere in the world? Combining 'micro' or interpretive methods with 'macro' or structural traditions, the book provides a nuanced account of legal reforms in China and Vietnam, highlighting the factors likely to promote, change or resist the spread of the Chinese model.

One Definition a Day: ASEAN

"ASEAN (Association of South East Nations) was formed in 1967, following the Bangkok Declaration of 8 August by the foreign ministers of Indonesia, Malaysia, Philippines, Singapore and Thailand. Brunei joined in 1984 and Vietnam in 1995. Papua New Guinea has observer status. The original agreement were strengthened and extended at the Bali summit of February 1976. A secretariat was established and agreement was reached on the outline of a trade bloc. Internally, ASEAN covers a spectrum of economies which have one thing in common - actual and potential economic dynamism. 

The whole Pacific Basin has witnessed the most impressive economic growth rates globally over the last two decades, within this region South East Asia shown the greatest self-awareness of the need for cooperation and coordination of policy in both the military-security and wealth-welfare contexts. Structurally, China and Japan threaten to dominate the sub-region in both these key issues areas. The ASEAN states have sought to balance against this putative domination by involving the entire Pacific basin and outside parties such as the European Union and the United States in regional diplomacy. The ending of the Cold War, the demise of the Soviet Union and what many see as the hesitancy within the USA to exercise leadership might be seen as exacerbating these needs. 

1993 witnessed two key developments that were headed by ASEAN: the formation of the ASEAN Regional Forum, which linked the ASEAN States with eleven Pacific Basin countries plus the EU, and the institutionalisation of Asia-Pacific Economic Cooperation, often referred as APEC with the establishment of a Secretariat in Singapore."

 IR - One Definition A Day: NIC - Newly Industrialized/Industrializing Country (p. 372, réf 1)

NIC is an acronym for Newly Industrialized / Industrializing Country (both terms are found in the literature). 

There is some debate and discrepancy about the membership of this grouping but four unequivocal NICs can be identified in the region of East Asia: South Korea, Taiwan, Hongkong and Singapore. Other putative NICs in other regions of the system are referred to below. In passing it should also be noted that of the above four, Hongkong is sui generis. Its status was that of a dependent territory, not a state: it has now been repatriated to China. Nor does its undoubted economic prosperity make it typical of the NICs. Unlike the other three, Hongkong has developed as a key financial and business centre, playing an entrepôt role vis-à-vis China and East Asia in general.

Notwithstanding the Hongkong case, the NICs have been able to expand their manufacturing sectors because they have enjoyed advantegeous comparative costs vis-à-vis the market leaders, the advanced industrial countries (AICs). They have a high level of entrepreneurial skill amonst their populations, an open economy regarding foreign invesetment and stable, if undemocratic, potlitical regimes. 

The emergence of the NICs exemplifies a real shift in productive resources from the North to selected sites in the South. Typical examples of manufacturing growth can be cited in such fields as: cars and trucks, consumer electrical goods, shipbuilding, steels and textiles. Among Third World states the NICs stand out for their achievement of self-sustained, export-led economic growth. They have, moreover, avoided the kinds of debt problems associated with the recent economic performance of the putative NICs of Latin America. 

The evident success of these NICs has had two effects upon the relations in the field of political economy. First, their success has weakened the concept of Third World solidarity. Ideologically the NICs have achieved their impressive economic performance by applying the principles of economic liberalism and by following the example of Japan. They have been willing to see multinational companies (MNCs) investment in their economies and have often facilitated such capital flows by offering a permissive taxation regime to corporations. Their political systems, if stable, have poor human rights records and limited and restricted opportunities for participation. 

The second consequence of NIC success has been that it has provoked a backlash amongst the AICs. One form this has taken has been for increases in protectionism on the grounds that 'cheap' imports are flooding into home markets from these areas. A second response, particularly favoured in the United States, is to argue that the NICs have 'graduated' into the first division and that henceforth they should cease to regard themselves, or be regarded by others as Third World states requireing special consideration. Institutionally their appropirate destination would seem to be the Organisation for Econocomic Cooperation and Development (OECD) according to this perception.

Four unequivocal NICs were identifed earlier. Overlapping membership with the colloquial Asian Tigers is evident. 

Putative membership for the next decade and the new century must include many - if not all- of the recently identified big emerging markets (BEMs).

About VCL- VIỆN NGHIÊN CỨU CHIẾN LƯỢC NGOẠI GIAO

Viện Nghiên cứu Chiến lược Ngoại giao chính thức được thành lập theo Quyết định số 82/2008/QĐ-TTg của Thủ tướng Chính phủ ngày 26/03/2008 về Quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Học viện Ngoại giao trực thuộc Bộ Ngoại giao. Ý tưởng xây dựng Viện Nghiên cứu Chiến lược đầu tiên được nhắc tới từ những năm 2003 - 2004, khi Lãnh đạo Bộ Ngoại giao nhận thức rõ nhu cầu phát triển nghiên cứu cơ bản và nghiên cứu chuyên sâu của Bộ. Viện Chiến lược tích cực phối hợp với Văn phòng Học viện tổ chức nhiều hội thảo quốc tế, trong đó cán bộ nghiên cứu của Viện đóng vai trò chủ chốt trong việc xây dựng nội dung chương trình hội thảo, tham gia trực tiếp chủ trì và trình bày tham luận.

Về các tác giả:

• Karl Peter Schönfisch hiện nay là trưởng văn phòng đại diện của Học viện Hanns Seidel Foundation tại Singapore và đồng thời cũng là giám đốc chương trình quản lý đào tạo địa phương. Trước đây, ông là trưởng phòng liên lạc của Học viện Hanns Seidel Foundation ở Bonn và Brussel là cũng là người đứng đầu Tổ chuyên trách Đông Nam Á Thái Bình Dương ở Munich. Ông tốt nghiệp ở trường Đại học Kỹ thuật RWTH Aachen của nước Đức với chuyên ngành Hợp tác kinh tế địa lý và kỹ thuật.
• Berhard J. Seliger hiện nay là đại biểu của Học viện Hanns Seidel Foundation ở Seoul. Từ năm 1998 đến năm 2002, ông là giáo sủ trợ giảng ở Đại học Hankuk về lĩnh vực nghiên cứu quốc tế và từ năm 1999 là nghiên cứu sinh ở Học viện nghiên cứu hệ thống kinh tế văn hóa của Đại học Witten/Herdecke của Đức. Từ năm 1995 đến năm 1998, tiến sĩ Seliger làm việc cho Học viện về Chính sach kinh tế thuộc Đại học Christian Albrechts ở Kiel của Đức với tư cách là nghiên cứu sinh, và cũng tại đây ông cũng nhận bằng Tiến sĩ (Dr. Sc. Pol) vào năm 1998. Tiến sĩ Seliger tốt nghiệp Thạc sĩ tại trường Đại học Paris I Pantheon-Sorbonne. Ngoài ra Tiến sĩ còn tham gia nghiên cứu trong các học viện Đông Bắc Á về lĩnh vực Kinh tế, Hội nhập và chuyển đổi kinh tế và phát triển kinh tế Hàn quốc.
• Pengiran Mashor Pengiran Ahmad là Phó tổng thư ký hội hiệp các nước Đông Nam Á từ tháng 8 năm 2003. Ông là Đại sứ trước đây của Brunei Darussalam khi đến Việt Nam, Bỉ, Hà Lan và Cộng đồng Châu Âu. Ông đã từng là Tổng thư ký Hiệp hội Hàn quốc -Đức về Khoa học xã hội. Các tác phẩm mới nhất của ông bao gồm Sự thay đổi về quan hệ Mỹ-Nga sau khủng bố ngày 11 tháng 9, tác phẩm này được xuất bản trong Global Economic Review, kỳ 31, soos2, năm 2002, Chính sach hành động của Putin về Bắc Hàn, được in xuất bản trong Tạp chí quốc tế về Nghiên cứu thống nhất Hàn quốc, kỳ 11, năm 2002.

• Jose L. Tongzon là Phó giáo sư khoa Kinh tế, trực thuộc Đại học quốc gia Singapore. Chuyên ngành của ông là Phát triển thương mại, Kinh tế vùng Đông Nam Á. Ông tham gia giảng dạy các khóa học liên quan đến phát triển kinh doanh và đã cho ra đời nhiều bài báo và tạp chí về lĩnh vực phát triển kinh doanh, các vấn đề về Cảng và luật hàng hải. Trước khi tham gia NUS, Tiến sĩ Tongzon là nhà kinh tế đứng đầu của Cảng Melbourne, nước Úc và đồng thời ông cũng là một viện sĩ ngành Dân của Úc và làm việc nhiều năm cho chính phủ Philippine trong lĩnh vực Hợp tác vùng và Chính sách thương mại. Tiến sĩ Tongzon là một thành viên rất năng động của Học viện Đặc quyền về vận tải (CIT), Hiệp hội các nhà kinh tế hàng hải quốc tế (IAME), và của các hiệp hội gồm những nhà kinh tế chuyên nghiep khác. Ngoài ra, ông cũng là nhà tư vấn cho những tổ chức chính phủ, tư nhân và quốc tế.
• Nattaphong Thongpakde hiện nay là Trưởng khoa Phát triển kinh teess tại Học viện quốc gia phát triển hành chính Thái Lan. Ông là chuyên viên tư vấn của chương trình Quan hệ kinh tế quốc tế của Học viện nghiên cứu phát triển Thái Lan. Ông tốt nghiệp tại trường Đại học Boston về chuyên ngành Kinh tế. Những tác phẩm mới nhất của ông chuyên về đề tài Những vấn đề thương mại, Phát triển kinh tế Thái Lan và Hợp tác song phương trong vùng Đông Á.
• Mohd Hafla Piei hiện nay là Hiệu phó Học viện Kinh tế Malaysia, một trong những nhóm chuyên gia cố vấn độc lập hàng đầu với trụ sở tại Kuala Lumpur. Trước khi tham gia MIE, từ năm 1995, Tiến sĩ Mohd Hafla Piei là giáo sư trợ giảng và trưởng khoa ngành kinh tế tại Đại học quốc gia Malaysia ở Kuala Lumpur. • Phạm Quốc Trụ hiện nay là Phó tổng giám đốc Ban Hợp tác Kinh tế đa phương của Bộ Ngoại Thương Việt Nam. Ông tốt nghiệp bằng Tiến sĩ và Thạc sĩ với chuyên ngành Khoa học chính trị tại Đại học Layal, Canada. Ông không ngừng đóng góp vào quá trình hội nhập Đông Á qua những cuộc thương lượng đa phương của ông. Những tác phẩm sách và nhúng tác phẩm gần đây của ông nói về Vai trò của Việt Nam trong Kinh tế thế giới, Những vấn đề thương mại và hội nhập vùng.
• Jae-Seung Lee là giáo sư trợ giảng Học viện Ngoại thương và An toàn quốc gia, thuộc Bộ ngoại thương thương mại Hàn quốc. • Karl-Peter Schönfisch is currently director of the regional representative office of Hans Seidel Foundation in Singapore and director of the regional leadership and management training programme. Before, he worked as director in the liaison office Bonn (Germany) and Brussels (Belgium) of Hanns Seidel Foundation and had been Head of the Southeast Asian and South Pacific Desks at HSS in Munich. He holds a degree in Economics, Geography and Technical Cooperation from Technical University RWTH Aachen (Germany). 
• Bernhard J. Seliger is currently resident representative of HSF in Seoul. From 1998 to 2002, he was Assistant Professor at the Graduate School of International Area Studies of Hankuk University of Foreign Studies and since 1999 Research Fellow at the Institute for Research Into Culture and Economic Systems, Univ. of Witten /Herdecke (Germany). From 1995 to 1998, Dr. Seliger worked as Assistant Researcher at the Institute for Economic Policy, Christian-Albrechts-University at Kiel (Germany), where he received a doctorate (Dr. Sc. Pol) in 1998. Dr. Seliger also holds a Master Degree from Université de Paris I (Panthéon-Sorbonne, France). Among the research interests of Dr. Seliger are Institutional Economics, Economics of Transformation and Integration and the Economic Development of Korea in Northeast Asia.

The Authors

• Pengiran Mashor Pengiran Ahmad is Deputy Secretary General of ASEAN since August 2003. He is a former ambassador of Brunei Darussalam to Vietnam, Belgium, the Netherlands, and the European Communities. He holds a Degree in Defence and Strategic Studies from the Royal College in Defence Studies in London and an MA Degree in International Relations and Diplomacy of Tufts University, Boston.
• Werner Pascha is Professor of Economics and East Asian Economics at the University of Duisburg /Essen. From 1996 to 1998, he was Director at the Institute of East Asian Science in Duisburg University. Since 1999, he is Vice-Chairman of the German Research Institute for the Economic Development of the Pacific Region. He holds a Ph.D. in Economics from Freiburg University. Among his numerous research grants are an AKS Fellowship at the Academy for Korean Studies in Seoul and a Japan Foundation Fellowship at Kyoto University in Japan. His numerous publications focus on the East Asian region, especially Northeast Asia.
• Gerhard Prosi is Professor Emeritus of Kiel University, where he had been Director of the Institute for Economic Policy from 1973 to 2001. Currently he is Vice-Chairman of Herrmann Ehlers Foundation. Before, he had been teaching in Princeton University, Southern Methodist University in Dallas and the University of Dallas, Irving. He holds a Ph.D Degree in Economics from Marburg University in Germany. Among his research interests are Competition Policy and Theory, Environmental and Social Policy and Comparative Economic Systems, including European Integration.
• Jinwoo Choi is Professor in the Department of Political Science and Diplomacy in Hanyang University of Seoul, as well as Assistant Dean of the College of Social Sciences of Hanyang University. Currently, he is Director General of the Korean Society for Contemporary European Studies. Professor Choi holds a Ph.D Degree in Political Science from University of Washington. He also served in numerous academic associations, among them as Research Director in the Korean Association of International Studies and as Director-General in the Society for European Political Studies.
• Sangtu Ko is currently Professor of Area Studies at Yonseil University, Seoul. He got his Ph.D in Political Science from Free University of Berlin, was General Secretary of the Korean-German Association for Social Science. His recent publications include: Change of US-Russia Relations after the September 11 Terrorist Attacks, published in the Global Economic Review, vol. 31, no. 2, 2002; The Putin Administration's Policy about North Korea, published in the International Journal of Korean Unification Studies, vol. 11, 2002.  
• Lee Jongwon is Professor in International Economics at Suwon University. He holds a Ph.D Degree in Economics from the University of Roma. He serves currently as Chairman of the Board of the Korean Society of Contemporary European Studies, where he formerly had been President, and Editorial Director of the Korean International Trade Research Association. He wrote various books and papers regarding International Trade issues and European Integration issues.
• Jose L. Tongzon is Associate Professor at the Department of Economics, National University of Singapore. He specialises in Trade and Development, focusing on the Economics of Southeast Asia. He has taught Trade and Development-related courses at NUS and has written a number of articles in internationally referred journals and books in the area of Trade and Development, including Port and Maritime issues, with special focus on Southeast Asia. Before joining NUS, Dr. Jose Tongzon was Chief Economist of the Port of Melbourne Authority, Australia, and also worked as an Academic and in the Civil Service for the Australian and Philippine Government for several years working in the area of Trade Policy and Regional Cooperation. Dr. Tongzon is an active member of the Chartered Institute of Transport (CIT), the International Association of Maritime Economists (IAME), and other associations of professional economists. He has also been a Consultant to a number of governments, private and international organisations.
• Nattapong Thongpakde is currently Dean of the School of Development Economics at the National Institute of Development Administration, Thailand. Mr Thongpakde is a Senior Consultant in the International Economic Relations Program of the Thailand Development Research Institute. He holds a Degree in Economics from Boston University. His recent publications focused on Trade issues, Thailand's Economic Development and Regional and Bilateral Cooperation in East Asia.
• Mohd Haflah Piei is currently Deputy Director at the Malaysian Institute of Economics, one of the premier independent think-tanks based in Kuala Lumpur. Prior to joining MIE and since 1975, Dr. Mohr Haflah was Associate Professor and Deputy Dean of the Faculty of Economics at the National University of Malaysia in Kuala Lumpur. Dr Mohd Haflah graduated with a Ph.D Degree in Economics in 1983 from the University of Lancaster, UK. He has worked in and contributed extensively to the field of International Trade, particularly in issues pertaining to International Economic Integration. He has served as Consultant to many international organisations, including World Bank, Asian Development Bank (Manila), Islamic Development Bank (Jeddah), UNDP (Kuala Lumpur), ISEAS (Singapore), East-West Centre (Honolulu), Japan Institute of International Affairs (Tokyo), Asian Development Bank Institute (ADBI, Tokyo), IDE (Tokyo), Sasakawa Peace Foundation (Tokyo), ASEAN Secretariat, Asian-Europe Foundation (ASEF, Singapore). Dr. Mohd Haflah was a member appointed by the Government of Malaysia to represent the country on the High Level Task Force on ASEAN-AFTA-CER Free Trade Area of the ASEAN Secretariat, Jakarta. He has published several books and numerous articles in his field of specialisation.
• Pham Quoc Tru is currently Deputy Director General of the Department for Multilateral Economic Cooperation in the Ministry of Foreign Affairs of Vietnam. Dr Tru holds a Ph.D and MA Degree in Political Science from Laval University, Canada. He is actively involved in the process of East Asian Integration through his participation in multilateral negotiations. His numerous recent publications and studies focus on Vietnam's role in the World Economy, Regional Integration and Trade issues.
• Jae-Seung Lee is Assistant Professor at the Institute of Foreign Affairs and National Security, Ministry of Foreign Affairs and Trade, Korea. Professor Lee has taught at Yale University, Seoul National University, and many other institutes in Korea. Professor Lee also participated in drafting the EAVG Report and published numbers of books and articles on East Asian Cooperation. His area of expertise also includes European Integration and International Political Economy. Professor Lee holds a B.A. in Political Science from Seoul National University, an M.A. Degree and a Ph. D Degree in Political Science from Yale University.
• Young-jong Choi is Professor in the Department of International Studies at the Catholic University of Seoul. Dr Choi hold a Ph.D Degree from the University of Washington in Seattle.
• Seokwoo Kim is Assistant Professor in the Department of International Relations at the University of Seoul. Dr. Kim holds a Ph.D Degree in Political Science from the University of North Carolina at Chapel Hill.
